Criminal Vehicular Operation And Criminal Vehicular Homicide

Minnesota's criminal vehicular operation statute establishes major penalties for a person who negligently causes a fatality or serious injury while driving under the influence of alcohol or drugs. The potential penalties depend on the severity of the accident:

  • Bodily harm, substantial bodily harm or great bodily harm - Up to five years in prison or a fine of up to $10,000
  • Injury or death to an unborn child - Up to five years in prison for injury or 10 years for death or a fine of up to $20,000
  • Death of a human being - Up to 10 years in prison or a fine of up to $20,000

Aggravating factors that may influence or enhance these penalties include fleeing the scene of the accident, prior DWI-related convictions, or extreme BAC of .16 or greater.
