Determining an Equitable Divorce Settlement

October 24, 2014 by Sheridan & Dulas, P.A.

Divorce is a very stressful process, with emotions often taking control. Despite the bitterness and anger, it is important for Minnesota residents to understand their rights and make the right decisions. By understanding the law, individuals going through a divorce can ensure they receive a fair settlement to help secure their futures.

The divorce settlement is based on each individual’s goals, for both the present and the future. There are often numerous issues involved in a divorce – including property division, child support, child custody and alimony. Although the goal is to focus on collaboration and settle these issues outside of court through mediation or negotiation, that may not be possible based on the attitude of your spouse. If a courtroom battle is necessary, a family law attorney can act as your advocate and guide you as to which aspects should be important and which battles to let go.

Minnesota is an equitable distribution state, which means that, while not everything will be split 50/50, asset division is determined by what is considered fair. This is based on each person’s contributions to the marriage. A lawyer can help you understand what this means in your individual case and help you maximize your outcome.

Everything is analyzed and reviewed, from assets and liabilities to living arrangements and retirement income. There are likely aspects of the divorce that you have overlooked, but your lawyer will help you use everything to your advantage and come up with creative solutions. Learn more about how an experienced lawyer can help you reach a divorce settlement that fits your future needs.
