The Cry for Enhanced DUI Penalties Seems to Be Getting Louder

March 5, 2015 by Sheridan & Dulas, P.A.

We have talked about drunk driving penalties, drunk driving accidents, and many of the myriad factors that are involved with DUIs. But today we’re going to take a more of a macro view to the issue of drunk driving consequences than a micro one. Today, we’re going to talk about the prospect of making the consequences for drunk driving harsher or more punitive, and what that effect would have on society.

You don’t have to look too hard to see that this is something that many people want. In fact, just type “drunk driving penalties” in to Google News and see how many of the results are calls for modified or increased drunk driving penalties.

It feels like it is a nearly universal decree by all of the states, but of course that is a bit hyperbolic. Still, it is clear that many people would like to see enhanced penalties for DUI offenders. This is problematic because the penalties already in place do plenty to punish the offender — yet they rarely do anything to help the offender, or motivate him or her to change his or her life for the better.

DUI penalties make it harder for the offender to maintain or find a job. DUI penalties make it harder for them to find suitable living conditions. They make it more difficult for them to get around town; to apply for something without having their criminal history brought up; to just live a normal life.

You may say “well that’s what they deserve for committing a crime.” And in some ways, that’s true. But constantly having DUI offenders suffering from harsh punishments doesn’t guarantee they will reform their ways. In fact, it could push them to drink more, and maybe get another DUI. More isn’t always better. Sometimes, a little bit of nuance can make a huge difference.
