Domestic Violence: Straddling The Line Between Family Law And Criminal Defense

March 17, 2016 by Sheridan & Dulas, P.A.

For couples on the cusp of divorce, it doesn’t take much for a minor argument to get out of hand. A terse exchange can quickly devolve into shouting, shoving and potentially something more serious.

If the police are called, chances are that you or your partner will face legal consequences. Even if you assume things will get sorted out once cooler heads prevail, or the alleged victim later recants or asks that charges not be filed, the prosecutor can still bring charges. Once charges are brought, the consequences immediately start to pile up.

There’s More At Risk Than Just Jail Time Or Fines

If you have been accused of domestic violence in Minnesota, there’s a lot you need to consider. If convicted, you could spend time in jail, be required to pay substantial fines, and face probation. But even a misdemeanor assault conviction will result in a lifetime ban on the possession of firearms and consequently keep you from hunting. And if you are not a citizen of the United States, you will be deported.

More than just criminal consequences, a conviction can also impact your personal and professional life. Having a criminal record can make it difficult to get or keep a job, find housing, and could seriously affect the relationship you have with your children should you and your spouse divorce and need to determine child custody and support.

It’s this overlap between family law and criminal law that makes it important to work with a law firm experienced in handling both practice areas. Your attorneys can help you understand your options for avoiding a conviction while also outlining strategies for protecting your relationship with your children and keeping you in your own home.

Every Moment Is Critical

At the law firm of Sheridan & Dulas, P.A., our attorneys can review your case and offer advice tailored to your specific situation. This means not jumping to a quick, easy plea agreement. We will listen to your side of the story, ensure your story is heard, and take appropriate steps to protect your rights.

It’s important to act quickly to respond to criminal charges and take appropriate action to address any restraining order. In some cases, you could be in violation of a restraining order without even knowing it. Instead of trying to figure everything out on your own, our lawyers can help ensure you have the information and representation necessary to take the next steps.
