Helping Couples Understand The Benefits Of A Prenup

April 5, 2017 by Sheridan & Dulas, P.A.

Couples in Minnesota sometimes take the time to carefully consider what they might do if their relationship fails. This is especially true whet the couple decides to get married. While it is not required to include a prenuptial agreement in a marriage, a prenup offers many benefits to each spouse if they decide to get divorced.

At our law firm, we understand the roles a prenuptial agreement can play during dissolution. Our law firm is dedicated to helping residents in the Eagan area understand whether or not a prenup is in their best interest. For most married couples, a prenuptial agreement is a means for asset protection and to ease the property division process.

But, in order to enjoy the benefits of a prenup, it must be valid and enforceable. At our law firm, we have helped past clients carefully craft prenuptial agreements so that they adhere to specific legal formalities. We will ensure both spouses make a full financial disclosure, each have the opportunity to have legal counsel review the final version of the prenup, ensure that the agreement is fair and equitable at the time of its signing and enforcement and confirm that the prenup was properly signed, witnessed and notarized at least one day prior to their nuptials.

A prenuptial agreement can take on a variety of purposes for a couple intending to get married. These purposes often include the ability to define the rights of each respective party during the divorce process, define how each spouse will handle their income during the marriage, clarify what is and what is not marital property, explain how expenses will be paid during the marriage and to determine the respective rights of each spouse at death.

To learn more, please visit our law firm’s prenuptial agreement website. While these legal documents are commonly included in unions of the rich and famous, these documents can be beneficial for any couple intending to get married.
